DISCLAIMER: I Am Not A Racist! BUT What About Donald Sterling's Constitutional Rights??

So by this point we have all heard the infamous Sterling “racist tapes” and as bothered as I am about the comments he made, I am even more bothered that we have somehow seem to have forgotten that he IS a United States Citizen.

As a U.S. Citizen, Sterling is guaranteed five freedoms by the First Amendment – and one of these just so happens to be Freedom of Speech. It is important to remember that Freedom of Speech is not a right that is absolute, but not even under the exemptions that the United States Supreme Court has recognized does the comments that Sterling made justify the penalties he is enduring.

The only category that I would classify Sterling’s comments would be made under the Fighting Words category, BUT fighting words are written or spoken words that are expressed to INCITE hatred or violence from their target.
